Yes, the Texas Certification Board (TCB) now allows peers on deferred adjudication to apply for certification.
Previously, individuals on deferred adjudication were automatically rejected because deferred adjudication is not considered a formal conviction until the probationer satisfactorily completes their probation period. That policy has since changed.
The “I” (Incomplete) Designation
TCB now allows peers on deferred adjudication to apply for initial certification. However, they will be placed under an automatic “I” (Incomplete) designation until they are off probation and meet the full certification requirements.
What You’ll Need to Do
Once you are off probation and meet the timeframe requirements outlined in the TAC Chart of Offenses for your specific offense, you will need to submit the following to TCB:
- A new criminal history report
- A copy of your court document(s) confirming that probation has been completed
- Confirmation that you have no new or pending charges
Once these are received and reviewed, TCB will reassess your certification status accordingly.
